don't be too sure. there is no 'tracking' involved, just a nice wide
angle camera with probably it least a 1/500th shutter or more, and lots
of light from a big orange strobe. If you are in front of the van, it
is likely you will be in the frame and in focus. In fact if you are
closer, it is less likely you could get off due to having 'other
vehicles' in the frame, and more likely they could interpret your number
plate.
5) That camera was very busy that night as I looked in my rear view... I
think every car that cam through was snapped...
You might be lucky - sometimes they rationalise the ticket sending and
only send to the fastest %age of people snapped. Just because you saw
a flash, does not necessarily mean you will get a ticket...
I don't know if a dangerous driving charge will follow (Apparently
+36km/h)
...but, if you were doing 36km over, you might just get one.
I will probably obtain legal advice via a friend in the know as to what
actions to take...
Don't stress until you get a ticket (then request the photo). If you
get one, you can either accept you were doing wrong and pay the fine, or
dispute it. I have had camera tickets before, but I pay them as I
accept I was breaking the law. I have disputed other things such as
missed Regos, and 'no front plate' tickets, as I don't see them as a
danger to others, and disputing these points of law is fun.
You may want to pay a lawyer if they charge you with dangerous driving -
but it depends on how much money & time you have to throw away vs how
much you value a spotless driving record.
Oh, and there are no 'rules' with regards to speed camera placement -
they can be put wherever they want. It started off with the only in
'speed camera area' signs, but there was no law around this - just a
general 'good faith' treatment of the issue by police. Also with the
'not too close to change in speed zone' thing. You could possibly use
it as an 'unfair' issue in a court case, but not an 'unlawful' or
'technicality' issue.
Ohhh well 1st speeding infringement ever in my 7 1/2 years of driving...
7 1/2 years driving?! Aren't you tired?
