Who brought a 1.8 from RB Parts

Post by chris » Fri Mar 14, 2014 12:54 pm

Hi there,

I was told recently that my engine has been sold. Without my authority etc. Obviously not particularly happy, it was sold from RB Parts, if anyone has any info on the where abouts of my engine, that would be hugely appreciated.

This may be a silly question, but if it was your engine how/why was it sold?

Not a silly question at all.

It had been stored there, and I had been in contact with them to pick it up this weekend. They got sick of having it lying around so they put it on trademe..

Looks like it was Jared with the Megasquirts in Tauranga.

Not sure what difference it would make getting in touch with the buyer though, if it's RB Parts who presumably shouldn't have sold it in the first place :?

Yeah, go lightly and just be polite and up front, but it sounds like that's your approach anyway.

You may be considering it already, but I'd probably be looking at legal action, either a police complaint if possible (not sure whether this comes under theft et cetera) or the Disputes Tribunal. Door's open if you want me to see if I can do some digging and find out where you stand legally.

I understand that the buyer had no fault at all in this matter, therefore no point shooting any blame or anything towards him.

I have thrown up talking to the police, however in all honesty, I have enough drama going on at the moment I'd like to avoid having to do that.

Hi Chris

I bought the engine from RB parts a few days ago.
Had no idea that they didn't own it.
I would normally be happy to get my funds back from RB Parts, and return the motor from you

But due to having an engine fail on me (faulty Cam angle sensor) a few weeks back
Then buying a supposedly 46,000k 1.8 from one engine importer, only to open it up and find the sump, cam cover and oil pickup completely covered in sludge.
Got my money back, and purchased another 1.8 low k engine in supposedly good condition, only to bolt on the turbo, injectors, sump, clutch etc, fit it into the car, then it make a pathetic 150hp ATW on the dyno, as opposed to the 240hp ATW it should have made, - gave it a compression test and found 90, 120, 130, 160 instead of a healthy 175 all around - made me more than a bit stressed.

Wouldn't normally be an issue, but am doing Playday on Tracks South island tour in less than 8 days, and didn't have a decent engine in the racecar. Having forked out a fair bit of tin for the racing, accommodation, ferries etc am not really in a position to not use the motor, might be able to sort something out when I get back (assuming I don't blow it up as it will have to handle around 280hp)

Do you have any history on the motor - kilometres, overall condition etc.

From what they said on their faceboob page the engine had been there a year with no contact

Most places will hold something for 3 months then sell or dispose of it.

@Teamjelly - no worries at all, as I said, you weren't aware of it, and therefore you shouldn't have to suffer for it.

Has around 100k (I think) on it, can't remember any more specifics.

Furai - A year.. I confirmed payment 7 months ago.. lol

I had been in contact with them. Regardless a very shitty thing to have happen.

Seeing as you've put their name out there it might be fair to explain briefly what kind of arrangement and contact you had with them over having an engine uncollected at their premises for the better part of a year.

Anything in writing..? Nope =[
Everything was either done in person (when I picked up my other bits and pieces) Or left on their voicemail.

Now, I should point out that I am not trying to talk shit, or bad mouth RB Parts, shit happens, and understandably (I hope) I am rather guttered/pissed off.

In a short term, I was very slack on the keeping in touch/picking the engine up, however, they also had all of my contact details, if they had made me aware that they were going to list it then I would have made arrangements to have it picked up.

Yeah, that sounds fair. I don't think anyone thinks it's cool that it got auctioned off without giving you notice, although by the same token you also seem aware as I think many might agree it also probably wasn't a good idea to leave it sitting there unclaimed without making arrangements.

I know unclaimed goods in the case of hotels are able to be auctioned off if they're not reclaimed after six months, and then if the proceeds of the auction (minus storage costs) also aren't claimed by the owner then they have to be paid to the Department of Inland Revenue.

So possibly by legal parallel you might be able to claim the proceeds of the auction, which would be... $300 it seems :?

Yeah - I have looked into it, and in all honesty, it's not worth the hassle, I have more than enough on my plate at the moment, cannot be assed adding any more.

You should be entitled to your money back if you paid a deposit/for it...
