That Accident + Parking Ticket!

Hi Eric

Hear you on that - could have been a little oil on the road too as you get at
some heavily trafficked intersections. 420 degrees is quite a spin alright.

Was lucky not to come back to an empty car park space this morning in Queen
St, Central Auckland. Was rushing to a job and got a park right outside the
building. In big letters the parking advisory sign said "P 30".

Rushed inside, completed the work and came out 20 minutes later to see the car
hauled up by a tow truck, which was waiting for a space in the traffic to pull
out. Just managed to flag the towie down in time. Parking Warden asked me to
have a closer look at the sign - sure enough in small lettering near the
bottom - there it was: "Parking 5 minutes". The large "P 30" applied only on
weekends - but this advisory was also in small lettering near the bottom.

In my hurry, I'd only noted the "P 30". Cost me a $40.00 parking ticket +
$52.00 towage & the parking warden said my error was in no way defensible.

I didn't argue, because at least I didn't have the fright of loosing the car,
having to find out where it was and then get a taxi out to Mt Eden to pick it
up - Phew! (Especially as my next appointment was only 10 minutes away!)

And a little cheaper I think too - towing is $180.00 (or was when it happened
to me this time last year - dodgy circumstances there too).

They tried that in Christchurch as well. (Christchurch City Council Warden)
I took a photo of the sign, from inside the car, I submitted that the major
part of their signage indicated P30, and as the major part of the week was
Monday to Friday it was fair to relate the information to that period.
Got told tuff, read the sign.
I have a mate who is a lawyer, he wrote them a similar letter, in fact I
emailed him mine and he made some "legal" adjustments and told them he would
see them in court.
Apparently these signs must be able to be read and and "reasonably"
interpreted for there intended use, i.e. from a car at a reasonable
distance, some thing to do with "contract" law, because that is what you
enter into when you park and pay your money.
Any way, I got off.
Try it, it may work.
